ACCEPTABLE USE POLICY

Portal Home Hub, Inc. ("Portal Home Hub," "we," "us," or "our") is committed to maintaining a safe, respectful, and lawful platform for all users. This Acceptable Use Policy ("AUP") outlines the rules and standards that all users must follow when accessing or using our Services.

This AUP is part of, and incorporated into, our Terms of Use and Privacy Policy. By using our Services, you agree to comply with this AUP. Violation of this policy may result in suspension or termination of your account and access to our Services.

1. SCOPE AND APPLICATION

1.1 Who This Policy Applies To

This AUP applies to all users of our Services, including:

  • Property seekers and consumers
  • Real estate agents and brokers
  • Landlords and property managers
  • Property owners selling directly (FSBO)
  • Developers and builders
  • Service providers and partners
  • Visitors and anonymous users

1.2 What This Policy Covers

This AUP governs all activity on our platform, including:

  • Property listings and descriptions
  • Photos, videos, and other media uploads
  • Profile information and user accounts
  • Messages and communications between users
  • Reviews, ratings, and comments
  • Forum posts and community interactions
  • API usage and integrations

2. PROHIBITED ACTIVITIES

The following activities are strictly prohibited on our platform. Users who engage in these activities will face enforcement action, including potential account termination and legal action.

2.1 Illegal Activities

You may not use our Services to:

  • Engage in or promote any illegal activity
  • Violate any local, state, national, or international law or regulation
  • Facilitate money laundering, tax evasion, or other financial crimes
  • List properties used for illegal purposes or obtained through illegal means
  • Engage in securities fraud or unlicensed financial services
  • Violate sanctions or trade restrictions
  • Infringe on intellectual property rights

2.2 Discrimination and Fair Housing Violations

Portal Home Hub is committed to equal housing opportunity and compliance with fair housing laws. All property listings and user conduct must comply with applicable anti-discrimination laws, including but not limited to:

  • U.S. Fair Housing Act
  • EU Equal Treatment Directives
  • UK Equality Act 2010
  • Local fair housing and anti-discrimination laws in each market

Specifically Prohibited:

  • Discriminatory listings: Property listings that discriminate based on race, color, religion, national origin, sex, disability, familial status, age, sexual orientation, gender identity, marital status, or any other protected characteristic
  • Discriminatory language: Descriptions, photos, or communications that suggest preference, limitation, or discrimination against protected classes
  • Steering: Directing or discouraging buyers/renters based on protected characteristics
  • Selective responses: Refusing to respond to inquiries based on protected characteristics
  • Prohibited phrases: Terms like "no children," "adults only," "perfect for Christian family," "able-bodied," or similar discriminatory language

Note: Some jurisdictions allow limited exceptions (e.g., senior housing, shared housing with owner-occupied properties). Property Professionals must verify local law compliance and clearly document legal exemptions.

2.3 Fraudulent and Deceptive Practices

You may not:

  • Post false or misleading listings: Listings for properties that don't exist, aren't available, or contain materially false information
  • Use stolen or unauthorized photos: Photos that don't represent the actual property or are taken without permission
  • Misrepresent prices: Advertise significantly different prices than actual asking/rental prices
  • Bait-and-switch tactics: Advertising one property to lure users, then showing different properties
  • Impersonate others: Falsely claim to be a property owner, agent, or representative
  • Create fake accounts or profiles: Multiple accounts to manipulate reviews, inflate listings, or evade bans
  • Phishing or scamming: Attempting to obtain financial information, deposits, or payments through fraudulent means
  • False credentials: Claiming false licenses, certifications, or professional qualifications

2.4 Harassment and Abusive Behavior

You may not:

  • Harass, threaten, intimidate, or stalk other users
  • Use hate speech or promote violence against individuals or groups
  • Post content that is defamatory, libelous, or harmful to reputation
  • Send unsolicited commercial messages or spam
  • Engage in sexual harassment or unwanted romantic advances
  • Dox or publish private information about others without consent
  • Create a hostile or toxic environment for other users

2.5 Inappropriate Content

You may not post content that:

  • Contains pornography or sexually explicit material: Including in property photos or profile images
  • Depicts graphic violence or gore: Violent, disturbing, or shocking imagery
  • Promotes self-harm or suicide: Content that encourages dangerous or harmful behavior
  • Exploits minors: Any content that sexualizes, endangers, or exploits children
  • Promotes terrorism or extremism: Content supporting terrorist organizations or violent extremist ideologies

2.6 Security and Technical Violations

You may not:

  • Hacking or unauthorized access: Attempt to gain unauthorized access to our systems, other user accounts, or secure areas
  • Distribute malware: Upload viruses, trojans, worms, or other malicious code
  • DDoS or system disruption: Overload or disrupt our servers or networks
  • Scraping without permission: Use automated tools (bots, scrapers, crawlers) to extract data without authorization
  • Reverse engineering: Decompile, disassemble, or reverse engineer our software
  • Bypass security measures: Circumvent authentication, rate limiting, or other security features
  • API abuse: Exceed rate limits or use the API in ways that harm platform performance

2.7 Spam and Commercial Abuse

You may not:

  • Post duplicate or repetitive listings
  • Create fake listings to generate leads or traffic
  • Send unsolicited bulk messages to users
  • Use our Services primarily for advertising unrelated products or services
  • Manipulate search rankings through artificial means
  • Create fake reviews or ratings for yourself or competitors
  • Engage in keyword stuffing or other SEO manipulation

2.8 Intellectual Property Violations

You may not:

  • Use copyrighted images, videos, or text without permission
  • Infringe on trademarks or service marks
  • Copy listings or content from other platforms or users
  • Violate patents or trade secrets
  • Use Portal Home Hub trademarks or branding without permission

2.9 Circumventing the Platform

While we facilitate connections between property seekers and Property Professionals, we encourage all users to conduct transactions safely and transparently. However, you may not:

  • Request upfront payments before showing properties or providing services
  • Use the platform to facilitate illegal transactions
  • Mislead users about transaction processes or required documentation

3. CONTENT STANDARDS AND GUIDELINES

3.1 Property Listings

All property listings must:

  • Be accurate and truthful: Property descriptions, prices, availability, and features must be accurate
  • Include actual property photos: Photos must represent the actual property being listed, not stock images or other properties
  • Disclose material defects: Known issues, repairs needed, or significant problems must be disclosed
  • State clear terms: Price, payment terms, lease duration, deposits, and conditions must be clear
  • Include proper authorization: You must have legal authority to list the property
  • Be updated regularly: Remove or mark as unavailable when sold/rented

3.2 Photos and Media

All uploaded media must:

  • Be high quality and clearly show the property
  • Not be digitally manipulated to misrepresent the property
  • Not include people without their consent (faces should be blurred)
  • Not contain watermarks from other platforms or photographers without permission
  • Be appropriate for a professional real estate platform

3.3 Professional Profiles

Property Professional profiles must:

  • Use your real name and accurate professional information
  • Include valid license numbers where required by law
  • Use a professional profile photo (no logos as profile pictures)
  • Not make false claims about experience, sales, or credentials
  • Include accurate contact information

3.4 Communications

All messages and communications must be:

  • Professional and respectful
  • Related to legitimate property transactions
  • Free from spam, solicitation, or harassment
  • Compliant with anti-discrimination laws
  • Truthful and not misleading

4. ENFORCEMENT AND CONSEQUENCES

4.1 Monitoring and Review

Portal Home Hub reserves the right, but is not obligated, to monitor, review, and moderate all content and user activity on our platform. We may use automated systems, human moderators, and user reports to identify potential violations of this AUP.

4.2 Enforcement Actions

Depending on the severity and frequency of violations, we may take the following actions:

  • Warning: First-time or minor violations may result in a warning
  • Content removal: Violating content will be removed without notice
  • Feature restrictions: Temporary or permanent restriction of messaging, listing, or other features
  • Account suspension: Temporary suspension of account access (typically 7-30 days)
  • Account termination: Permanent ban from the platform
  • Legal action: Referral to law enforcement or civil litigation for serious violations
  • Financial penalties: Forfeiture of subscription fees or damages recovery

4.3 Immediate Termination Offenses

The following violations will result in immediate account termination without warning:

  • Child exploitation or endangerment
  • Terrorism or violent extremism
  • Serious fraud or financial crimes
  • Hacking or system compromise
  • Human trafficking or illegal activity
  • Repeated violations after previous suspensions

4.4 Appeals Process

If you believe enforcement action was taken in error, you may appeal by contacting us at appeals@portalhomehub.com within 30 days. Your appeal should include:

  • Your account information
  • Explanation of why the action was incorrect
  • Any supporting evidence or documentation

We will review appeals within 14 business days and respond with our decision. Our decision on appeals is final. For EU users, you have the right to lodge a complaint with your local data protection authority if you believe your rights have been violated.

5. REPORTING VIOLATIONS

5.1 How to Report

If you encounter content or behavior that violates this AUP, please report it immediately. You can report violations through:

  • In-platform reporting: Use the "Report" button on listings, profiles, or messages

  • Fair housing violations: fairhousing@portalhomehub.com

5.2 What to Include in Your Report

When reporting a violation, please provide:

  • Link to the violating content or profile
  • Description of the violation and which policy it breaks
  • Screenshots or evidence (if applicable)
  • Your contact information (for follow-up if needed)

5.3 Confidentiality

We treat all reports confidentially. Your identity will not be disclosed to the reported party unless required by law. We do not tolerate retaliation against users who report violations in good faith.

5.4 False Reports

Filing false or malicious reports is a violation of this AUP. Users who repeatedly file false reports may face enforcement action.

6. ADDITIONAL PROVISIONS FOR EU USERS

6.1 Digital Services Act (DSA) Compliance

For users in the European Union, we comply with the Digital Services Act (DSA). This means:

  • Transparency: We provide clear information about content moderation decisions
  • Internal complaint system: You have the right to appeal content moderation decisions
  • Out-of-court dispute resolution: Access to certified dispute resolution bodies
  • Statement of reasons: When we take action, we provide specific reasons referencing this AUP

6.2 Right to Judicial Redress

EU users have the right to bring legal action before the courts in their Member State if they believe we have violated applicable EU law, including the DSA or consumer protection regulations.

6.3 Trusted Flaggers

We work with certified trusted flaggers in the EU who have expertise in identifying illegal content. Reports from trusted flaggers receive priority review.

6.4 Transparency Reporting

We publish annual transparency reports detailing:

  • Number of content moderation actions taken
  • Types of violations detected
  • Number of user reports received
  • Appeals and their outcomes

7. COOPERATION WITH LAW ENFORCEMENT

We cooperate fully with law enforcement authorities and regulators. When we identify illegal content or activity, or receive lawful requests from authorities, we will:

  • Preserve relevant evidence
  • Provide information as required by law or valid legal process
  • Report illegal content to appropriate authorities
  • Comply with court orders and subpoenas

For EU users, we comply with the procedures established under the DSA for cooperation with national authorities and the European Commission.

8. CHANGES TO THIS POLICY

We may update this Acceptable Use Policy from time to time to reflect changes in law, our practices, or user feedback. When we make material changes, we will:

  • Update the Last Updated date at the top of this policy
  • Notify users via email or platform notification
  • Post a notice on our website or mobile app
  • Provide at least 30 days notice before enforcing material changes

Your continued use of our Services after the effective date of changes constitutes acceptance of the updated policy.
